  • process payments and maintain business and financial records;

  • provide coaching services and personalize our work together;

3. EMAIL AND MARKETING

What we collect. Your name (if provided), email address, email engagement data as described in Section 5, and tags reflecting the free content you requested or the products you purchased. We do not tag subscribers based on health information, interest form submissions, or coaching client status.

How we use it. To deliver the content you requested, to send service-related messages about your purchase or request, and to send marketing emails about our products and services.

Automatic addition. If you join our mailing list, request free content, submit an interest form or contact form, make a purchase, or become a coaching client, you are added to our marketing email list.

How to opt out. Every marketing email includes an unsubscribe link. You may also email us at hello@thevitalfeminine.com to be removed. Transactional and service-related emails relating to an active purchase or service are not optional.

Retention. If you unsubscribe, we retain your email address on a suppression list indefinitely for the sole purpose of honoring your opt-out and ensuring you are not contacted again.

4. DISCLOSURE OF YOUR INFORMATION

We do not sell your personal information, and we do not share it for advertising purposes. We do not serve third-party advertisements on the Website.

We disclose your personal information only in the following limited circumstances:

Service providers. We use third-party service providers to operate our business, including our website host and platform, email and messaging platforms, payment processor, cloud storage and document platforms, scheduling and video conferencing tools, form tools, and analytics providers. These providers process your information on our behalf, under contract, and are not permitted to use it for their own purposes.

Legal compliance and safety. We may disclose your personal information to courts, law enforcement authorities, or other third parties where legally required, or where we have a good faith belief that disclosure is reasonably necessary to respond to a subpoena or court order, conduct an investigation, bring or defend legal action, prevent harm to you or others, or address a violation of our Terms of Service or applicable law.

Business transfer. If we sell, merge, or transfer all or part of our business, personal information such as your name, contact details, and purchase history may be transferred as part of that transaction. We will provide notice as required by law. We will not transfer health information as part of any such transaction without your written consent; where consent is not given, we will delete it.

With your consent. We will not use anything you share with us — including your responses to any form or assessment, your health information, and the contents of our communications — in testimonials, marketing, or promotional content without your separate written consent. This is separate from our marketing email list, described in Section 3.

5. COOKIES, TRACKING, AND EMBEDDED CONTENT

Essential cookies. Always active. These are required for the Website to function and cannot be disabled.

Analytics. We use the analytics built into our website platform to understand how visitors use the Website — pages viewed, traffic sources, device and browser information, and general location. We use this only to improve the Website. We do not use this information to build advertising profiles.

Email. Our emails may contain tracking technologies, such as pixels and tracked links, that tell us whether an email was opened and which links were clicked, along with device and browser information and general location. We use this only to understand which content is useful and to maintain our mailing list. We do not use this information to build advertising profiles. You can limit this by turning off automatic image loading in your email app, or stop it entirely by unsubscribing.

Embedded content from other websites. Pages on the Website may include embedded content — for example, videos, social media posts, or resources hosted elsewhere. Embedded content behaves exactly as if you had visited that other website directly. Those websites may collect information about you, use cookies, and embed additional third-party tracking, including tracking your interaction with that content. We do not control these third-party cookies. We encourage you to review the privacy policies of any third-party site whose content appears on the Website.

You can manage your cookie preferences through your browser settings.

6. COACHING CLIENTS

This section applies in addition to the rest of this Privacy Policy if you work with us as a coaching client.

Confidentiality. What you share with us in the course of our work together is confidential. We do not disclose your personal or health information to anyone without your written permission, except in the limited circumstances described in Section 4.

Not a HIPAA covered entity. The Vital Feminine LLC is an independent health coaching business, not a licensed healthcare provider or clinical entity. We are not a "covered entity" under HIPAA, and our records are business records, not clinical medical records.

Retention. Except as described in Sections 3 and 8, we retain your personal information for six (6) years after the coaching relationship ends, or longer where reasonably necessary to resolve disputes or defend legal claims, and then securely delete or dispose of it. If a consumer health data law applies to you, you may request earlier deletion as described in our Consumer Health Data Privacy Policy.

7. DATA SECURITY

We implement reasonable technical and organizational measures to safeguard your personal information.

However, no method of transmitting or storing information electronically is completely secure. Transmission by internet, email, text message, audio or voice note, or video conference carries inherent risk. You acknowledge that any transmission of information to us is done at your own risk. To the extent permitted by law, we disclaim liability for unauthorized access or data breaches beyond our reasonable control.

8. DATA RETENTION

We retain your personal information only for as long as reasonably necessary for the purposes for which it was collected, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

  • Business and financial records, including purchase records, invoices, agreements, and consents: retained indefinitely for tax, accounting, and legal-defense purposes.

  • Coaching client personal information: as described in Section 6.

  • Inquiries and interest form submissions from people who do not become clients: twelve (12) months.

  • Marketing email addresses: as described in Section 3.

9. YOUR PRIVACY RIGHTS

You may:

  • request a copy of the personal information we hold about you;

  • request correction of inaccurate information;

  • request deletion of your personal information, subject to our legal and business record retention obligations;

  • withdraw consent to any sharing you previously authorized;

  • receive your information in a portable format; and

  • opt out of marketing communications at any time.

10. CHILDREN'S PRIVACY

The Website and Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. Our Terms of Service further require that all users be at least 18 years of age. If you believe we may have unknowingly collected information from a child under 13, contact us immediately at hello@thevitalfeminine.com and we will promptly delete it.
